Community payback order for assault offence       3/8/11

A Lewis teenager who assaulted a female as well as a police officer has been placed on an one year community payback order.

John Maciver, 18, of 12 Branahuie, Point, Lewis, also damaged a Toyota Corolla car. He previously pleaded guilty to the offences.

Sheriff David Sutherland ordered him to carry out 120 hours of unpaid work. He was also tagged and placed on a six month curfew from 10pm to 6am nightly.

Fiscal David Teale told Stornoway Sheriff Court that Maciver was drunk and in an agitated state while walking with the female youth on Jamieson Drive, Stornoway, in the early hours of Sunday 3rd July.

He seized the girl and threw her on the car bonnet and held her down said the fiscal. She was crying but managed to break free and get away, he added.

Maciver kicked and damaged the front grill and wing mirror of a nearby vehicle and was aggressive when police attended.

Lawyer Angus Macdonald said the officer deflected the punches aimed at him and they landed on the man’s chest.

MacIver was “extremely remorseful” for his behaviour which was “out of character,” he added.

The root of the problem was “as in 90% of cases is excessive alcohol” pointing out that MacIver has “not had a drop” since.
