Lifetime driving ban                   13/10/11

Two Lewis brothers who, on separate occasions, took the same car without permission and drove it while over the legal drink limit were sent to jail when they appeared at Stornowaay Sheriff Court.

Donald Macleod, 26, of 13 Brue, Barvas, received an eight months prison sentence and lost his driving licence for life.

He previously pleaded guilty to taking the car without consent on 11 September and driving it at Arnol while disqualified.

The court was told he had an alcohol reading of 134mg against the legal level of 35mg, making it nearly four times the limit. His lawyer said there was no excuse for his actions.

He said: “He accepts it was totally the wrong thing to do. Drink is always a problem for Mr Macleod.

He added that prison will be “beneficial as far as his health is concerned.”

Sheriff David Sutherland said: “By any measurement the level of alcohol in this case is extreme and easily have ended in a fatality.”

Two weeks later, his younger brother Domhnall Calum Macleod, 20, took away the same vehicle, again without the owner‘s consent, and drove it without insurance. He also drove while banned and with an alcohol count of 65mg against the 35mg limit.

He previously pleaded guilty to the four charges.

Fiscal David Teale said he took the car keys from the owner’s home and drove off the roadway into a ditch.

He was standing by as it was being pulled out by a tractor when police came along.

Sheriff David Sutherland sentenced him to a total of six months in jail as well as a five year driving ban

A £600 fine was rounded up into the prison sentence.
