High Court trial told of fight                  7/5/13

Liam Aitchison and the two men accused of murdering him had a fight, Glasgow High Court heard this afternoon.

Warren Mackay, 24, from Stornoway, was giving evidence at the trial of Jonathan Mackinnon and Stefan Millar who deny murdering Liam Aitchison in November 2011.

The jury heard Millar was talking with friends, including Mr Mackay, after Liam, from Lochboisdale, disappeared.

The court heard Mr Mackay told police that Millar said that the three men had been drinking and had a “scuffle.”

In the statement Mr Mackay claimed that Millar told him that he and Mackinnon and Liam were “throwing punches” and that Liam had fallen into a ditch.

Mr Mackay told police that Millar alleged that he and Mackinnon watched Liam get out of the ditch and walk off saying he was going to Pemma Maclennan’s house in Stornoway- his girlfriend’s sister home where he stayed on occasions.

In evidence earlier, Mr Mackay had claimed that he could not remember the conversation with Millar.

But he told prosecutor Iain McSporran that was what he told the police.

In earlier evidence the court heard from Liam's girlfriend Ellen Maclennan who told police Millar said he left Liam in a ditch because he was rolling about and being an idiot.

Under cross examination by Frances McMenamin QC she agreed this was not what happened and that Liam was “rolling about the road.”

Mrs McMenamin asked the witness if she asked Millar 'why did you leave Liam in a ditch' and she replied: “I think so.”

The QC asked: “Would it be right in saying Stefan Millar's response was 'we never left Liam in a ditch, he was rolling about the road?'”

Ms Maclennan replied: “Yes.”

Mrs McMenamin asked: “Is that how the conversation went?” and she replied: “Yes.”

Peigi Maclennan, also known as Pemma, 22, told the court Liam had stayed with her on a few occasions.

She said he slept on her sofa at times and thought he would be staying there on the night of November 23, the day went missing.  

She told the court that in the early hours of the next morning, she returned home from a night out and he was not at her house.

Liam's body was found in a derelict property in Steinish, outside Stornoway, after he had been reported missing by his girlfriend Ellen Maclennan.

The trial before judge Lord Kinclaven continues.
