Western Isles Council’s legal action over a horse evicted from a house is “not competent” claims the lawyer acting for its owner.

 

Grey Lady Too lived with Stephanie Noble inside her home in Broadbay View, Back, on Lewis, for two years.

 

The council seized the adult Connemara pony, maintaining its welfare was at risk as living conditions were too cramped.

 

Since February 2014, it has been cared for at the Uist Community Riding School in Benbecula.

 

The council now wants to sell the horse or, alternatively, donate it to a rescue centre.

 

More time was previously granted to the local authority to amend its legal pleadings.

 

Contentious legal issues focus on the format of the court paperwork lodged by the council plus what the authority is lawfully entitled to do in the circumstances.

 

When the case called in Stornoway Sheriff Court this week, Ms Noble’s solicitor, Angus Macdonald, challenged the competence of the legal action.

 

In turn, the council lawyer asked him to highlight the legal grounds for his stance.

 

Sheriff David Sutherland adjourned the case for Mr Macdonald to outline the arguments for his position in writing.
