A lawyer acting for one of two sacked Western Isles grazings committee has demanded they are reinstated.

 

Brian Inkster said the commission acted unreasonably and beyond their powers in firing the members and clerk to the Mangersta Common Grazings Committee.

 

He has written to the commission requesting their reinstatement “without further delay.”

 

The solicitor highlighted the Crofting Commission had no authority to install a grazings constable to run the Mangersta common grazings

 

He stated: “The Crofting Commission does not have the power to do so under section 47(8) of the Crofters (Scotland) Act 1993.”

 

He added: “If the Crofting Commission decide to remove a committee of five and a clerk from office they must appoint, or provide for the appointment of, five committee members and a clerk to replace them.

 

“Therefore the Crofting Commission has acted illegally in appointing a grazings constable and any actions taken by him are null and void.”
